It is an unfortunate reality that dental practices will receive litigation complaints at some point, from a range of sources and on several different topics. The appropriate management of these issues from the start can determine very different outcomes.  

Any dentist who has been involved with litigation knows the time and costs that can be associated with legal matters. Not to mention the amount of time away from the practice resulting in a loss of income is detrimental to the dentist’s wellbeing and practice growth.  

The good news, there are steps that can be taken to eliminate some of the risk of litigation, and Alan has extensive experience in alternate dispute resolution proceedings and has acted as a mediator in the successful resolution of insurance claims.  

This seminar will look at some of the most common complaints in dental practices and how they can be avoided, where possible.  


BIOGRAPHY

I have practised civil litigation since graduating from law school in 1982. The first 35 years of my career were spent at the Macleod Dixon/Norton Rose Fulbright law firm. In December 2016 I moved my practice to Scott Venturo LLP, which is a better fit for my clients and my practice. I have appeared as counsel in the Provincial Court of Alberta (Civil and Criminal Divisions), Court of Queen's Bench, Court of Appeal and the Supreme Court of Canada. I have extensive experience in alternate dispute resolution proceedings and have acted as a mediator in the successful resolution of insurance claims. 

My practice is principally in the tort/liability defence and insurance fields with an emphasis on the defence of sophisticated, complex commercial claims, including product liability, commercial liability, fire/explosion, energy, aviation, professional negligence, and serious personal injury/wrongful death. I regularly act for a diverse group of international insurers and multinational manufacturers and have wide experience handling all manner of liability, property and casualty claims. 

I have been honoured and recognized by the following groups, publishers, and associations: - named as a leading practitioner in the areas of dental malpractice defence, personal injury defence, aviation, commercial insurance and product liability litigation by the Canadian Legal LEXPERT Directory - am one of only two Alberta lawyers to appear in the "International Who's Who of Insurance and Reinsurance Lawyers", a list of preeminent lawyers in the field - selected by my peers to be recognized in the U.S. published legal referral guide "Best Lawyers in America, Canadian Edition" as well as in "The Best Lawyers in Canada" in the areas of insurance defence and personal injury defence - chosen by my peers as Best Lawyers' 2015 Calgary Insurance Law "Lawyer of the Year" - annually designated by a Canadian legal ranking publication as one of the "Best Lawyers, Insurance Law" and one of the "Best Lawyers, Personal Injury Defence" in the country - selected by in-house counsel and my peers to appear in the Guide to the World's Leading Product Liability Lawyers, published by Expert Guides and the Legal Media Group - identified as one of the top products liability lawyers in Canada by the LawDay newsletter - in 2010 was appointed as a Fellow of the Litigation Counsel of America - recommended by Benchmark Canada, the Guide to Canada’s Leading Litigation Firms and Attorneys as a "litigation star" and one of the "preeminent litigation practitioners" in Alberta - "Unanimous peer opinion supports Alan Rudakoff being nominated as a litigation star in this (2013) edition of Benchmark Canada for his insurance and product liability acumen, which incorporates an aviation niche". I have also acted as a professional sports agent, certified by the National Hockey League Players’ Association (NHLPA) and the Professional Hockey Players’ Association (PHPA), representing players in their dealings and negotiations with professional sports teams.
